McGreevey lawyers battle over 'threesome' testimony

Divorce lawyers for former governor James E. McGreevey and his wife are arguing whether to allow testimony by a former campaign aide who claims he participated in sexual threesomes with the estranged couple.

The bitter divorce proceedings have hinged largely upon whether the former governor hid his homosexuality from Dina Matos McGreevey. His lawyer, Stephen Haller, argued in legal filings released today that testimony about the alleged encounters between 1999 and 2001 by the aide, Theodore Pedersen, will prove Matos McGreevey knew her husband's sexual preference before their 2000 nuptials.

"The fact that these encounters and three-ways took place before the marriage indicates that plaintiff (James McGreevey) was bisexual," Haller wrote.

Matos McGreevey has denied participating in the alleged threesomes.

Her lawyer, John Post, also argued that not even Pedersen knew the former governor was homosexual. In his filing released today, Post pointed to a deposition during which Pedersen was asked when he realized McGreevey was gay.

"When did you find out that Mr. McGreevey was gay," Pederson was asked during the 2007 deposition

"I found out, I think, a day before he announced it at the Statehouse," Pederson answered, according to the filings.

Post said the depostion makes Pederson's testimony about the alleged threesome irrelevant.
